These terms and conditions shall govern all contracts entered into by Lifestyle Appliances Ltd.
General

The seller only does business upon the terms of these conditions of sale which shall be deemed to be interpreted in any contract between the buyer and the seller. These conditions of sale shall not be altered or varied except by specific written amendment signed on behalf of the seller and shall take effect to the exclusion of any terms or conditions stipulated by the buyer.

 

Quotations

The seller reserves the right to cancel or withdraw any quotations without notice at any time before acceptance. A quotation issued by the seller does not constitute an offer to supply goods and any order placed by the buyer following a quotation issued by the seller shall not be binding on the seller unless and until accepted by the seller in writing.

 

Pricing

The price of goods is ex-works and excludes delivery or transport charges and insurance in transit and excludes V.A.T or any other tax Duty.

As a trade only company, it is our policy not to sell products directly to end user consumers  so that our clients have a fair opportunity to grow their own companies.  It is for this reason also that we do not provide suggested prices.

 

Delivery information

Any time or date for delivery named by the company  or its representatives is an estimate only. The company shall not be liable for the consequences of any delay and a delay will not entitle the buyer to claim damages and /or repudiate the agreement.

 

Payment Terms

Payment terms are strictly nett 30 days from the end of the month. Earlier settlement i.e. 7 days can be subjected to discount, this must however be negotiated and agreed at the time of ordering. All new accounts will be subject to a pro-forma, until a trading history has been established. Cheque or Bacs payment in settlement of invoices submitted should be made payable to Lifestyle Appliances Limited, Unit 66, Enfield Industrial Estate, Redditch, Worcestershire B97 6DE.

 

Retention of Title 

The seller reserves the right of title to the goods under the provisions of sections 19 The Sale of Goods Act 1979 until all monies owing have been paid in full by the buyer.

 

Carriage

 

Carriage

Carriage charges will apply on all orders is Lifestyle is required to deliver our goods to a third party / home delivery or by any other means other than our normal carrier services. Charges will also apply if the value is below a specified threshold. For carriage paid orders, please contact your local sales representative or sales office for up to date standard carriage charges.

 

Warranty Terms & Claims

Any claims for wrong or short delivery shall be put into writing by the buyer to the seller within 7 days or receipt of goods otherwise the claim will not be accepted. Goods presented by the buyer to be defective shall not form the subject of any claim for work done or for any loss of damages or expense whatsoever arising directly or indirectly from such defects. Such goods if returned to the company at the expense of the buyer and provided that the complaint has been received by the company within 7 days from the date of deliver and accepted by the company as defective, will at the option of the company be repaired or replaced by goods as nearly similar to that originally ordered. No defect or damage suffered by the buyer shall be grounds for cancellation of the remainder of the order contract.

 

In the event that one of our products has been declared faulty and is within the terms of our warranty policy, a free collection service will be provided. If our courier should be turned away due to 'goods not ready' a fee of £10.00 will apply.

 

Damaged Goods

if goods are received and are found to be damaged, the buyer must notify the company on the day of receipt as carriers will not normally accept claims more than 48 hours following delivery.

 

 

Content and Representation

Lifestyle Appliances have the right to protect company image and as such we expect the buyer to maintain this. All buyers are required to either inform us of any product feedback they have received, or respond by requesting that the buyer contact us directly to resolve their issue. 

 

We reserve the right to use any promotional material mentioning and/or containing images of our product. 

 

Sales & Promotions

Offers are subject to stock availability and Payment must be made within the specified time frame. Promotions can be cancelled at any time, buyers that have placed orders buy have not yet paid will be given the option to pay full price or cancel the order. Standard warranty & carriage policies will apply to all products. Orders made within the allocated time frame but cannot be delivered due to stock levels will be honoured where possible.

 

If the stock level is to be replenished, we reserve the right to uphold and/or extend the terms of the offer at our own discretion. For offers on stock that will not be replenished, the promotion will be cancelled and the buyer will not be entitled to any compensation. Changes to offers can be arranged however this must be confirmed by both parties in writing.
